1. Agreement to these terms
These Terms of Service are an agreement between you and 3 In 1 Environmental, the operator of Pick a Time. By creating an account, publishing a booking page, scheduling an appointment, or otherwise using Pick a Time, you agree to these terms and the Privacy Policy.
If you use Pick a Time for a company or other organization, you represent that you have authority to bind that organization. “Provider” means a business or professional offering appointments. “Client” means a person scheduling with a provider.
2. The Pick a Time platform
Pick a Time provides online tools for creating booking pages, presenting availability, collecting appointment information and files, sending transactional notifications, managing appointments, documenting acceptance of provider terms, and optionally synchronizing with Google Calendar.
Pick a Time is a scheduling platform, not the business performing the services shown on a provider's booking page. A provider is independently responsible for its services, pricing, licenses, insurance, safety, availability, communications, appointment policies, and legal compliance. Use of Pick a Time does not constitute endorsement or verification of a provider.
3. Accounts and security
- You must provide accurate, current information and maintain a valid email address.
- You are responsible for safeguarding your password, session, and appointment-management links.
- You must promptly notify us of suspected unauthorized access and are responsible for activity under your account unless prohibited by law.
- You may not share an account in a way that defeats plan limits or security controls.
4. Provider and client responsibilities
Providers must:
- publish accurate services, availability, locations, prices, policies, qualifications, and required notices;
- collect only information reasonably needed for scheduling and handle client data lawfully;
- obtain rights and permissions for submitted content and connected calendars; and
- independently review appointments and communications instead of treating email or calendar synchronization as an infallible record.
Clients must provide accurate contact and appointment information, submit only lawful content they are authorized to share, follow the provider's disclosed policies, and use management links only for their own appointments.
5. Appointments, rescheduling, and cancellation
An appointment is scheduled when Pick a Time records it as confirmed. Email-provider acceptance or a Google Calendar event is not a guarantee that an email reached an inbox or that a provider will perform the service. Providers and clients should confirm important appointments directly when appropriate.
A client may use the secure appointment link to reschedule or cancel when those controls are available. A provider may also manage appointments through its dashboard. Changes are subject to provider availability and policies. Rescheduling invalidates pending reminders for the old time; cancellation stops pending reminders, but messages already accepted by an email provider cannot be recalled.
Providers, not Pick a Time, establish service-specific cancellation, no-show, deposit, and refund terms. Canceling an appointment does not automatically cancel a Pick a Time subscription, and canceling a subscription does not cancel existing appointments.
6. Plans, payments, and subscriptions
Current public pricing offers five initial bookings at no charge and an Individual Pro subscription advertised at $15 per month. Features, usage limits, and prices may change prospectively. The price, billing interval, taxes, and other purchase details presented at Stripe checkout control your purchase.
Paid subscriptions renew automatically until canceled. By subscribing, you authorize Stripe to charge the payment method on file each billing period. You can manage payment details and available cancellation options through the Stripe Customer Portal opened from the Pick a Time billing dashboard. Access after cancellation depends on the effective cancellation date displayed by Stripe.
Except where required by law or expressly stated at purchase, payment of a subscription does not create an automatic right to a refund. Contact us regarding billing errors or any refund request.
7. Acceptable use
You may not use Pick a Time to:
- violate law or facilitate fraudulent, deceptive, or harmful acts;
- infringe privacy, intellectual-property, publicity, or other rights;
- upload malware or unlawful, abusive, discriminatory, or deceptive content;
- probe, scrape, disrupt, overload, reverse engineer, bypass, or gain unauthorized access to the platform;
- send spam, harvest personal information, impersonate others, or misuse client data; or
- rely on Pick a Time for emergency, life-safety, or other use requiring guaranteed real-time availability.
8. Content and privacy
You retain ownership of content you submit. You grant 3 In 1 Environmental a non-exclusive license to host, process, reproduce, and transmit that content as reasonably necessary to operate, secure, and support Pick a Time. You represent that you have the rights needed to provide that content.
Our collection and use of personal information is described in the Privacy Policy. Providers are independently responsible for privacy notices and legal obligations applicable to the client information they collect.
9. Third-party services
Pick a Time depends on third-party services, including Google for optional Calendar integration, Stripe for subscriptions, Neon for database hosting, Vercel for application and file hosting, Resend for transactional email, and Upstash QStash for notification scheduling. Your use of third-party services may also be governed by their terms and privacy policies.
We do not control third-party outages, account restrictions, policy changes, or data-processing decisions. A third-party interruption may delay or disable related Pick a Time features. Google Calendar is optional, and appointment email processing does not require a Google connection.
10. Suspension and termination
We may limit, suspend, or terminate access when reasonably necessary to address nonpayment, a security risk, suspected fraud, illegal or abusive conduct, a material breach of these terms, harm to users or the service, or a legal requirement. When practical, we may provide notice and an opportunity to correct the issue.
You may stop using Pick a Time at any time. Subscription cancellation alone does not delete an account or its data. Contact us to request account deletion. Provisions that by their nature should survive termination—including payment obligations, ownership, disclaimers, and liability limits—will survive.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICK A TIME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant uninterrupted or error-free operation, inbox delivery, successful third-party synchronization, detection of every scheduling conflict, preservation of every file, or the quality, safety, legality, or availability of provider services.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3 In 1 Environmental AND ITS AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR OPPORTUNITIES ARISING FROM PICK A TIME.
WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO DIRECT DAMAGES PROVEN AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. These exclusions and limits do not apply where prohibited by law.
13. Changes and general terms
We may update these terms prospectively as Pick a Time changes. We will post revised terms with an updated date and may provide additional notice for material changes. Continued use after revised terms become effective constitutes acceptance to the extent permitted by law.
If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them in connection with a reorganization, financing, sale, or transfer of the service.
